Creators Team Inc. ("we," "us," or "our") provides the brand asset sharing service "MediaKit™" (mdkt.in, the "Service") under these Terms of Service (these "Terms").
The Service is a platform where companies and organizations ("Registered Organizations") gather their brand assets — logos, brand colors, usage guidelines, and the like ("Listed Content") — on a single page to publish and manage, and where third parties who need them ("Visitors") can search, view, and download that content.
By registering an account with, or otherwise using, the Service, you are deemed to have agreed to all of these Terms. If you do not agree to these Terms, you may not use the Service.
These Terms are also available in Japanese. The English version is a reference translation only; in the event of any discrepancy between the Japanese and English versions, the Japanese version shall prevail.

§01Account Registration
To use certain features of the Service (registering an organization, adding or editing logos, colors, or guidelines, etc.), you must register your name, email address, and password, and create an account by verifying your identity with a confirmation code sent to that email address.
You must provide accurate information when registering, and must keep your login credentials, including your password, confidential and manage them at your own responsibility. Any action taken through an account is deemed to have been taken by the person who registered that account.
If we determine that any registered information is false, inaccurate, or incomplete, we may suspend or delete the account in question.
Minors who use the Service must obtain the prior consent of a legal representative (such as a parent or guardian).
§02Publication Settings of Organization Pages
A Registered Organization may choose one of the following publication settings for its own page (an "Org Page").
Shown in search results and listings, and accessible to anyone.
Not shown in search results or listings, but anyone with the URL can access it without a password.
Not shown in search results or listings; an access password is required.
- Public: Shown in search results and listings within the Service, and accessible to anyone.
- Unlisted: Not shown in search results or listings, but any third party who knows the URL can access it without a password. This setting is intended to keep the page out of search and browse, not to control access to it.
- Locked: Not shown in search results or listings, and the Org Page cannot be viewed unless the access password set by the organization is entered.
Regardless of which publication setting a Registered Organization chooses, it is solely responsible for deciding whether to allow third parties to view or download the Listed Content. We only warrant that the Service operates in accordance with the publication setting selected; we do not warrant any access control beyond that.
§03Listed Content
Rights in the logos, brand colors, guideline text, and other Listed Content uploaded by a Registered Organization remain with that Registered Organization and are not transferred to us. The Registered Organization grants us a non-exclusive license to use the Listed Content to the extent necessary to store, display, and deliver it through the Service.
Each Registered Organization represents and warrants that it lawfully holds the rights necessary to upload its Listed Content (including trademark, copyright, and other intellectual property rights), and that the Listed Content does not infringe the rights of any third party.
A Visitor's use of Listed Content is subject to the usage guidelines and scope-of-publication conditions presented by each Registered Organization on its Org Page, and we bear no responsibility whatsoever for the relationship between a Registered Organization and a Visitor regarding such use.
§04Prohibited Conduct
When using the Service, you must not:
- violate, or engage in conduct that risks violating, any law or regulation;
- upload content that infringes the copyright, trademark, or other intellectual property rights of others;
- impersonate an actual organization or entity, or create an Org Page that falsely suggests an affiliation with one;
- deceive, defame, or harass other users or third parties;
- obtain, bypass, or share the access password of a Locked Org Page without proper authorization;
- misuse the Service's report feature by submitting false reports;
- systematically collect data from the Service through scraping, crawling, or other automated means (this does not include ordinary indexing by search engines);
- impose an excessive load on the Service or any network or server connected to it, or otherwise interfere with its normal operation;
- reproduce, modify, or reverse-engineer the Service's software without authorization;
- transmit, or attempt to transmit, a virus or other harmful program; or
- use the Service for the purpose of building a competing service, or for any other improper purpose.
If we determine that a user has violated these Terms, we may restrict, suspend, or delete that user's account or Org Page without prior notice.
§05Reports
A Visitor may use the "Report" button on an Org Page to report Listed Content that they believe falls under any of the following categories. A report requires selecting a category and entering a name and email address.
- Trolling, harassment, or the posting of harmful files
- Sexual or violent expression or design
- Infringement of the rights of the reporter or an organization the reporter belongs to
- Any other violation of these Terms
We review reported content and, where we determine it is necessary, take action with respect to the relevant Org Page or Listed Content. We may not, however, respond individually to a report or notify the reporter of any action taken. Claims for damages arising from an infringement of rights between parties must be resolved directly between those parties; we do not, in principle, mediate such disputes.
§06Inviting Members to an Organization
A member with administrator ("Admin") privileges for an organization may invite another person to join that organization by specifying an email address. An invitation link is sent to the specified email address, and the recipient is added as a member (Admin or Member) once they sign in to a Service account and accept the invitation.
The invitation link expires 30 days after it is sent.
A member with Admin privileges may change the roles of other members and remove members. An organization's member list displays each member's name and email address.
§07Deletion of Content and Accounts
You may delete logos or brand colors you have uploaded at any time. Only a member with Admin privileges for an organization may delete that organization's Org Page. Deleted content, including uploaded files, stops being displayed and served through the Service, though it may remain on our systems for a limited time in backups or caches.
You may delete your own account from the dashboard. However, you cannot delete your account while you belong to any organization; you must first have an organization's Admin remove you as a member, or delete the organization itself (which only an Admin may do).
Deleting an Org Page also deletes that organization's registered logos, brand colors, guidelines, member information, and invitations.
§08Intellectual Property Rights
The Service's source code, databases, functionality, and design, together with trademarks and other intellectual property rights including the name and logo "MediaKit™," belong to us or to those who license them to us.
Subject to your compliance with these Terms, you are granted the right to access the Service and use it for your own non-commercial or internal business purposes. You may not reproduce, modify, redistribute, or use for commercial purposes the Service itself (excluding Listed Content) without our prior written permission.
§09Disclaimer
The Service is provided on an "as is" basis. We do not warrant that the Service will be provided without interruption or error, or that it is fit for any particular purpose.
Except where caused by our willful misconduct or gross negligence, we are not liable for any damages arising from your use or inability to use the Service. Even where we are liable for damages under a theory of breach of contract or tort, our liability — except where caused by our willful misconduct or gross negligence — is limited to ordinary, direct damages actually incurred by you, and we are not liable for damages arising from special circumstances (including where such damages were foreseeable or foreseen), lost profits, or indirect damages. In such a case, the aggregate amount of our liability for damages, regardless of the cause or type of claim, is capped at an aggregate total of ¥1,000. Where the Act on Regulation of Transmission of Specified Electronic Mail, the Consumer Contract Act, or other mandatory law renders all or part of this provision inapplicable, that law governs instead.
Each Registered Organization is responsible for the content, accuracy, and legality of the Listed Content it posts, and we do not warrant that content.
§10Changes to and Suspension of the Service
We may change, add to, or discontinue all or part of the Service without prior notice. We may also temporarily suspend the Service due to system maintenance, failures, or other unavoidable circumstances.
Except where caused by our willful misconduct or gross negligence, we are not liable for any damages you incur as a result of such changes or suspension.
§11Exclusion of Antisocial Forces
You represent and warrant that you (and, if you are a corporation, its officers and any person who substantially controls its management) do not, and will not in the future, fall under any of the following categories: a crime syndicate (bōryokudan), a member of a crime syndicate, a person who ceased to be a member of a crime syndicate less than five years ago, an associate member of a crime syndicate, a company affiliated with a crime syndicate, a corporate racketeer (sōkaiya), a social-movement racketeer, a specialized intelligence crime group, or any person equivalent to the foregoing (collectively, "Antisocial Forces"), and that you do not maintain a socially objectionable relationship with any Antisocial Forces.
You further undertake, whether personally or through a third party, not to engage in violent demands, unjust demands exceeding legal responsibility, threatening or violent conduct in connection with a transaction, the spreading of rumors, the use of fraudulent means or force to damage our credit or interfere with our business, or any conduct equivalent to the foregoing.
If you violate either of the preceding two paragraphs, we may, without prior notice, suspend or delete your account or Org Page or take any other measure we deem necessary. Except where caused by our willful misconduct or gross negligence, we are not liable for any damages you incur as a result.
§12Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service between us and a user shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
§13Changes to These Terms
These Terms constitute standardized terms and conditions (teikei-yakkan) under the Civil Code of Japan. We may change these Terms where the change serves the general interest of users, or where the change does not contravene the purpose of the contract and is reasonable in light of the necessity for the change, the appropriateness of the content after the change, and other relevant circumstances. When we make a change, we will announce the content of the revised Terms and their effective date, by posting on the Service or other appropriate means, no later than the effective date. If you use the Service on or after the effective date, you are deemed to have agreed to the revised Terms.
